The Effects of AT&T’s $25M Fine in the Call Center Industry




Call centers located in Colombia, Mexico, and Philippines are on AT&T’s watch list due to data breach affecting almost 280,000 US customers. The Federal Communications Commission (FCC) has entered a $25 million settlement with AT&T Services, Inc. to resolve an investigation into consumer privacy violations at AT&T’s call centers located in the said countries. The fine  is FCC’s largest privacy and data security enforcement action to date.

The outcome of the said fine has started to take effect in call center companies. In Mexico, the incident has been investigated by the local authorities’ trough The Federal Institute for Information Access and Data Protection, or IFAI.

According to reports, a Mexican media said the theft in Mexico was carried out by three employees of Teleperformance, a provider of call center services to AT&T, IFAI said in a statement.
The Mexico City-based IFAI said it decided to launch a preliminary investigation due to potential non-compliance with Mexico's Federal Law on Protection of Personal Data.

The Philippine local authorities have not started any formal investigation of the issue. The country has enacted The Data Privacy Act or Republic Act 10173 last 2012 but the president has yet to make a National Privacy Commission that would regulate the data privacy policies under the law.

As a result of the fine we have heard reports that some AT&T accounts have been pulled out from different call center companies leaving hundreds of agents in floating status.  Some call center employees also stated they still have AT&T account with their company however they are also concerned of losing a job once AT&T’s contract has ended with their respective center.

Colombia may have the same fate of losing AT&T account because an AT&T spokesperson has wrote to Ars Technica with the following message “Protecting customer privacy is critical to us. We hold ourselves and our vendors to a high standard. Unfortunately, a few of our vendors did not meet that standard and we are terminating vendor sites as appropriate. We've changed our policies and strengthened our operations. And we have, or are, reaching out to affected customers to provide additional information.”

So the next time someone approached you if you are working for an AT&T account and being offered to look for customer information for a small fee; please think of honest call center employees who’s working real hard just to make ends meet.  Also, your company might follow the strict rule of implementing the "no cellphone rule on the floor policy" and monitoring your computer activities because of this incident.

To protect the call center industry the Philippine government should start implementing the National Privacy Commission, I think BPAP should also start implementing rules and guidelines as well if they don't have anything in place.

  6. Agents find ways to earn more because the call centers they work for don't provide enough remuneration that really fit their agents' needs. Admit it, as we all know that out of the revenues the call center get from the clients, ONLY 5 % goes to the commission. So i won' fully blame the agents as they only want to earn more... i know it's fraud... but then again if the company you work for doesn't give the ryt amount of commission due to you then fraud will never end. Most of the call center companies in the Philippines are greedy. And because of that, the lawsuit these clients filed against to some companies are somewhat something these companies deserve. Especially call centers ran by Chinese.

Kaya maawa kayo sa mga ahente na kung itrato nyo e parang utang na loob pa namin na may sinasahod kami... isipin nyo rin na kaming mga agents ang nag gegenrate ng money sa company nyo.     2. I understand the sentiments of those who feel that they are being under compensated by their companies. But i do not agree with their stand that they will resort to fraud because of these reasons. Why? Because:
      1. No one is forcing you to stay with your company. Everyone has the right to leave the company they are in and look for "greener pasture." You may feel that your pay is mediocre but is your feeling the same as your teammates'? If you really are not happy with your co
      2. You are not the only one affected if the account pulls out. Although you are the only one who benefits from your fraudulent acts. Do not take away the chance from other people to out food on their family's table. DO NOT BE TOO SELF CENTERED.
      3. This goes beyond your company. This is a measure of your own self worth. Your sense of INTEGRITY.

      Do not jeopardize other people's jobs just for the sake of some individual's greediness.

  7. I sympathize with the call center worker, having to endure long periods of work with poor wages and benefits. That however is no excuse to become a thief. For the job seeker and employee working in this industry, I feel it is best to ensure that the company that you join has a solid ethics in business policy. No law should be required to convince a company that it is purely smart business to protect it's customers as well as it's employees using a "best practices" model which reflects the highest standard of integrity.

    2. i worked for the call center industry for about 10 years total. I would have to say that yes there are a few instances that they are underpaid. but then again let me say this. 1. a bank teller definitely earns less than a call center agent, but they survive. 2. A teacher also earns less than a call center agent and still survives. I guess its not because of "mababang kita" but more of not being able to manage their earnings.

    5. Yung mga bank teller and teachers naman gumagastos din. I think its more of Benefits na nakukuha nating mga call center agent kasi aminin natin or hindi yung work natin is sobrang hirap compared s benefits na binibigay ng company. Bank tellers and teachers have holiday off and it's paid unlike call center agents na nagwowork even holiday. Health kasi natin ang affected sa work natin especially sa mga graveyard puyat plus stress pa. Unlike the bank tellers and teachers they have time to petix while us mag-ACW ka ng 1 minute flagged kana kaagad ng work force. Kaya sana sa mga company, gandahan din nila ang mga benefits ng mga agent nila as well as the salary. It's not easy to be a call center agent.

  8. In what whatever reason we (agents) has no room for any wrong doing (fraud). No matter how greedy our center is. I know the fact that we are absolutely under paid comparing to others working in the US and Europe as agents also. I believe that this is a high for the government to take a look seriously about our welfare, the health benefits that we have.

  12. It is always our CHOICE. The CHOICE to be tempted to do FRAUD to earn extra money because of being underpaid. Our CHOICE to leave a company that UNDERPAYS & look for another company that pays better. & The CHOICE to lose our INTEGRITY, as a person, as a call center agent who would still look for a job in BPO industry even after committing FRAUD, as a citizen of a country who now has established a strong image in GLOBAL OUTSOURCING. Let's all THINK, CHOOSE, & DELIVER for our own benefit, family & countrymen. And let's all face it, EASY MONEY EASILY GOES AWAY, HARD SPENT MONEY IS WELL SPENT & WELL VALUED.

  13. I was also from TP-EDSA & I felt like I was so underpaid for 3yrs. Despite it I stayed because I am having fun with people I worked with back then. It never entered my mind to commit fraud & lose my integrity because I know for a fact that I would still look for another company in BPO industry & I thought of the image of our country now that we are considered reliable in global outsourcing. Let's face it, Philippines' bread & butter nowadays is the BPO industry & of course OFW industry. But when I really felt like I couldn't keep up w/ my monthly expenses because of being UNDERPAID, I CHOSE to leave & lose all the fun. It was a RISK. But it's all worth it. & now I'm working in one of the new call center companies that pays a lot bigger than an old company like TELEPERFORMANCE.

    1. If you want underpaid, look at jollibee and mcdonalds employees and SM mall employees (SM corporate pays better i think). Some call centers really are just for entry-level agents/sups. Most pay better than non- call center jobs, and some centers pay better than other call centers. You feel underpaid because you don't feel that your tenure and skill is additionally compensated or appreciated financially.

At&t in clark sutherland is one of the biggest fraud source, surprisingly account managers and senior account manager and i believe the newly promoted business director are backing up the fraud activity, even promoted an agent to a trainer position and not even 30 days fraud level spiked up, that "trainer" even got hired as an agent again for at&t business and still attempted to commit another fraud incident in a new company, risking the job security of all other honest hard working agents. That agent came from sprint, then at&t south east, then time warner and at&t business, he's well known because of his ridiculous opening spiel all through out the centers that he's been with!

  22. I agree with someone from this post. If you are not feeling happy with your pay or anything about your company, you are free to leave. Fraud acts are not the answer to get more money. That is too self centered. I love my team and work. It's really saddening that the whole account pulls out and here you are just doing your part, accepting calls/chat and just assist customers. You do get incentives when you are good. And yes it's not a lot. But you still can render over time. If you really need to earn more, do something else and make sure it will not affect everyone badly. You will never be succesful by getting something not yours. I was planning on studying again and be part time on chat. I think I can kind of do that. But now I need to find a new job so I can pay for school.

  26. At&t Mobility has been pulled out in Teleperformance Tektite (Pasig), Mall of Asia (Pasay) and SM Davao effective May 15/30. All its CSE/ Customer care Voice and CHAT are affected. Almost 2000 employees will be on floating status and reprofiled to another account.

  31. Please do not bring up being UNDERPAID coz we are not. There are so many ways to earn more if talagang kulang sayo ung sweldo mo. Overtime, incentives, etc kung kulang pa din...lifestyle check na kelangan mo.

    Ung mga hindi masaya sa Call Center job at pay, mag quit na and look for another industry or put up your own business. We'd be better off without you kung fraud lang din naman ang gagawin!

    BTW, our gov't should also take action. Wag na naten antayin na totally masira ang reputation ng Pinoy and eventually mawala ang industry na to saten.

    Ikaw ba? May lilipatan knb kung sakali mawala ang BPO industry sa Pinas? Will they pay you the same amount of money?

    1. ok, so you say you are being paid enough because you work extra time? diba dapat extra pay din yun? ilagay sa ulo ang utak, hindi yung may maicomment lang para sikat... we're talking about the base pay here! not the overtime pays and shit. you have to be paid right if you work right and be paid extra if you work extra... hindi yung work extra then just be paid for what was supposedly just the base pay na binabayad ng client. gunggong!!!

  36. At&t is pulling out all of its mobility LOBs because of the fraud issue. It only took a handful of people to make the majority of us jobless. Even the sites with no fraud issue were pulled out. The fraudster from StarTek was being investigated. Because of her stint she was able to afford a house worth 5M while we can't sleep at night, worrying if our company will have a post open for us or if we should just look for jobs else where. I really hope she and whoever else commited fraud gets punished.

Ang management ang dapat tinitingnan kc para mapaganda ang pangalan nila gagawin nila ang lahat, pressure nila mga coaches at team leads para mga agents nila ang mag suffer at during the point na maganda na ang stats ng team, may pera ang mga managers at sila ang may recognition at pera while ang agent na nagtrabaho ng mabuti may certificate lang.. Haha! Pagminsan pag �� ass ayun promote agad.. Politics lang yan.. Asa lahat ng klase ng trabaho.. Just my opinion. meron din mga agents na honest at hardworking din nman.. For that, they deserve their promotion..

  43. I am from CVG and despite the fact that VXI is one of our performing competitors who failed to deliver their duties appropriately under AT&T's demands (not even close to terms) I honestly feel this is absurd.

    We are called the slaves of the new millenium and as our industry evolves human nature dictates survival tactics using desperate measures. I can't blame anyone at all but I won't tolerate anyone. However, us humans to survive we normally keep out mouth shut when it comes to telling the truth. To be prank, no one will really say these things in front of those who failed or affected by these issues to uphold or protect them.     Let's be honest here... We're lucky we have Call Centers here where a lot of undergrads can earn. What would their other option be aside from good old manual labor? Don't get me wrong, I'm not trash talking manual labor. I LOVE IT. Pays less, but has more freedom in it. There is stability in it. But what I don't appreciate is those making the Mantra that they are UNDERPAID. We've been there. I've been with a company that tags you as absent even when there has been records that you have logged in and out. Leave credits that are disappearing despite you not using it. Selling out customer records is very, very unethical because you're putting your frustration on an innocent party.

    I'm lucky that I'm with a good company now, and here, we have co-workers trying to finish college, despite some having children of their own. Let's face it, to a lot of people, Call Centers are just stepping stones for a higher dream. You might want to get past it without ruining your reputation, or worse, make it harder for others doing honest work.

    4. we reps from VXI Davao are damn good especially in customer service that's why we are always on top... maskin gipangsipa na ang mga naknangpots na mga fraudsters number #1 man japon mi,nganu man na??? maskin amo morale naapektuhan na sa mga natabo, still our stats remained strong and awesome... what happened to us was truly devastating coz we have friends and workmates na we know honest ug limpyo sa trabaho pero natanggal kay nadamay, some of them are not even aware about fraud and how it is done... so dili cguro ka patakag putak coz u dont know everything, bcg magbula2 na imu baba murag nakaenum ug milk tea... pero wala na mi mabuhat, SHIT HAPPENS so dawat2 na lng... and speaking of SHIT, IKAW NA TO... hahaha!, halata au gkan ka sa bpo site na bottom ang stats and bitter au ka sa amu kahawod mao pasabot pipitsugin kag skills and how you do ur job... ur a faggot and pipol like u are the weakest link... and its a pun! hahaha... And you have mouths to feed, bread winner ka, and because of what happened naglisod na ug apply sa laing centers because of the selfishness of others! Selfishness sa incentives para sa mga fraudsters, and selfishness sa isa ka p*tang ina na arce na naghugas kamay para ma down ang ilang kakumpetensya na company.

    6. At&t in TP Dvo is closing / closed as well I guess it's this guys fault too... I think people should stop mentioning her.. I don't think one person can dictate a company as big as at&t. Mas pinapalaki nyo lang ang ulo niya feeling nya sya talaga nag pasarado sa center nyo... A lot of at&t centers in the Philippines are closing or down sizing as a business move they are just using fraud as a means of reason to cut costs. Unfortunately vxi, tp, cvg and other bpo's that has rampant fraud issues were made example of.

  50. I worked in Sutherland, VXI, and Teleperformance before. There are still a lot of people who work with integrity in those respected companies. So sad to say that they are fallaciously judged by these creeps.

  51. I worked in Teletech, TP, CVG, and VXI. I swear to God, I know all those manipulations, but I never tried even once. What disappointed me, are the old or pioneer employees who are bragging about their high positions but never was loyal to his/her company. Loyalty has integrity as a first ingedient, but in the Philippines only few people have that. It is not only with the account, but with workers alone. In one center at Novaliches, I just went to my Sup's table in 5 minutes suddenly my earphone was stolen. I know that the pay is not much, but very thankful because call center can suffice our needs. I have a foreign husband, but I told him proudly why I prefer staying in my country is because call center company offers a good working environment. Some have free coffee, which other countries never give, others have a gym and my favorite Lazboy. It's only contentment that those fraud people have an issue. I'm sorry but we should'nt act like patay-gutom. Coffee is free, alot would fill up their cups and bring it home. Anywhere I go, nowadays. . . Pinoys are known for fraud . . . Still I have faith that integrity and strength of mind is what we need to resist TEMPTATION. They know it's wrong, but never care. I may still work in a BPO, but be more careful to whom I work with . . . Especially those who talks nice, but with the evil eyes.

    1. The fraud issues has its domino effect. The pioneer managers/employees were taught by expats or trained Filipino employees in US. . . Almost halfly baked. . . So fraud, manipulations, malpractices, bad leadership, power tripping already started. . . Until few becomes OMs, Sups etc. . . And it worsens . . . Then, comes the fresh graduates, high-school graduates who were taught the way-ways . . . It became horrible . . . Especially the challenge of good stats, high incentives, rankings, etc . . . The horrifying, #1 center issue. . . That's where it all rooted from.. . Now that AT & T have the first move, other accounts will be more conscious and soon will also investigate... Sooner, hopefully those assholes who ruined the industry will pay for it. . .

  57. Good thing former AT&T Prepaid account agents have been absorbed to Cricket Mobile and performed better than the former account. Better is ... I'd left TP Sucat when this happened last January. Now, I'm in Alabang for AT&T Postpaid account at a call center here, and still getting the incentives and bonuses I wanted!
